Please read these Terms & Conditions carefully before using the website YouPhorBee Naturals with the official registered address of 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ.  Company Number 12496515.  By using or submitting an order on this site you are agreeing to the terms laid out below.

Your email address is essential in order for us to be able to supply you with important information such as order confirmations, product updates, offers and changes to the service. By registering with YouPhorBee Naturals, you accept to receiving email marketing as part of the terms and conditions.

1. GENERAL

1.1 If any of these Terms & Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

1.2 All copyright, trademarks and all other intellectual property rights in all material or content supplied on this website will remain at all times, the property of YouPhorBee Naturals. You are permitted to use the material data and content only for your personal use in placing orders through YouPhorBee Naturals, and you may not otherwise copy, reproduce, transmit, publish, display, distribute, commercially exploit, use or create derivative works of any material data and content on the website without our prior written permission.

1.3 While every care has been taken to ensure the product information shown on the website is correct, our products are sometimes being reformulated and content may change. Examine the label before you open it and return unopened if it is not to your satisfaction.

1.4 All product images used on our web site are only representative of goods on offer. Actual goods may not be exactly the same size, design or packaging. In the event that you are not happy with any goods received, you have the right to follow our refund and exchange policy.

1.5 Our products or services may contain links to third parties, and third parties contact links to YouPhorBee Naturals, that are not owned or controlled by us. As we have no control, we assume no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that YouPhorBee Naturals shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

2. PURCHASES

2.1 We will confirm acceptance of your order. This will occur either by message on the website immediately after you have confirmed your order, or by us sending an e-mail to the e-mail address you have provided to us. We may do both, in which case the acceptance will occur on whichever arrives sooner of the web message and the e-mail. At this point the purchase contract will be made (pending any security checks required) and we will supply the goods to you in accordance with your order and these Terms and Conditions.

2.2 If you wish to purchase any product or service made available through us, you will be asked to register an account. You will be asked to supply certain information relevant to your purchase including, without limitation, your name, address, email address and any other information required at the time.

2.3 For a purchase to be authorised it may be necessary for us to carry out a number of security/fraud checks, this may include and is not limited to address confirmation, direct contact with you or alternative payment method request.

2.4 You the customer, should always check that the contact information you provide is accurate before creating a customer account or proceeding to payment of goods.

2.5 You the customer are responsible for maintaining your own username and password for your customer account. You should ensure that you store your username and password securely and that these details are not disclosed to another party.

3. METHODS OF PAYMENT

3.1 The debit, credit and charge cards accepted by us are those listed on the web site on the date on which your order is placed.

3.2 Authority for payment will be requested from your card issuer at the time of your order. We 'debit' your card with the full price at the time of the order being placed. We reserve the right to terminate our agreement with you if we are refused authority for payment or reasonably believe that payment will be refused at any stage, or if it is found to be a fraudulent payment.

4. PRICE

4.1 The price of the goods or services will be as quoted on the web site at the time you confirm your order subject only to any inadvertent technical error for which we will not be liable. If you subsequently amend your order to add items, the prices charged will be those applicable to the new item(s) at the time that the amended order is confirmed. Please note that as promotions are offered for a limited period of time subsequent amendments to your order may mean that certain promotions are no longer being offered. We reserve the right to alter all product pricing without notice.

4.2 From time to time, and at our complete discretion, purchases of goods may be subject to special offers. In the event that such a special offer applies to your purchase, the terms of such a special offer shall be subject to these Terms and Conditions. If there is any conflict between the terms of a special offer and these Terms and Conditions, these Terms and Conditions shall prevail unless specifically excluded.

4.3 We may change the terms of special offers, or withdraw them altogether, at any time and without prior notice.

4.4 Prices, promotions and offers are subject to change at any time, and may also be subject to availability where stated.

4.5 Where a voucher code has been offered the terms and conditions will be attached to the voucher.

4.6 Each order you make may include a charge for delivery. If your delivery is subject to a delivery charge, it will be shown to you as a separate charge on the delivery confirmation page before you confirm your order. Any delivery charge added to your order will be dependent upon, amongst other things; the value of your order and your delivery address. 

5. SHIPPING/DELIVERY

5.1 Delivery will be made to the address specified by you during the order process on the website. You have the ability to change this address with each order through the website or by phoning or emailing us prior to the order. We reserve the right to restrict deliveries in certain areas, and this includes the right to eliminate certain areas from our delivery schedule altogether.

5.2 Products are subject to availability and prevailing market conditions. We may limit the quantities of goods (particularly goods on special offer) supplied to any one customer if in our opinion the quantity ordered jeopardises availability for other customers.

5.3 We will always try to supply you with the full quantity that you have ordered, but where we have stock level issues we may not be able to supply you with the full quantity at one time and may put part of the order onto backorder status. If you are not satisfied with the quantity you have received we will arrange with you for goods to be returned to us (please note that the goods must not be used and must be in good condition). In the event that the goods delivered to you are incomplete or include incorrect goods, you must notify us promptly.

5.4 Please note adverse weather conditions or other events outside of our reasonable control may result in the occasional late or cancelled delivery, this may also include late dispatch from the distribution centre. This is beyond our control and we will take no responsibility.

5.5 We cannot accept responsibility of international orders that are not delivered due to the country’s internal postal service, responsibility only falls where non-delivery is as a direct result of our own appointed courier service. 

5.6 The shipping charges and Information statement on our website forms part of these terms and conditions. This includes UK shipping, international shipping, costs, exceptions to free shipping, and international issues of non -delivery where we accept no liability.

5.7 You are responsible for providing the correct shipping address when processing your order. If the address provided is incorrect, you must notify our team within 1 hour of this mistake, in order for us to edit the shipping address. Please email info@youphorbeenaturals.co.uk. If the shipping address provided is incorrect and subsequently, the parcel is returned to our returns address, there will be an additional shipping charge to send out the parcel again.  We will do our best to dispatch orders within 2 – 3 working days.  Orders may be dispatched prior to this depending on stock availability. All orders placed on a Saturday or Sunday will be dispatched at the start of the next working week.

5.8 In the event that the goods delivered to you are incomplete, damaged or include incorrect goods, you must notify us promptly and we will arrange with you for the goods to be returned to us (please note that the goods must be intact, unused and must be in the received condition). You are entitled to return, or have refunded the value (at the time of purchase) of any incorrect goods or goods which you have not received. In any event, our liability will be limited to the price of the goods not delivered or incorrectly delivered and the cost of delivery.

5.9 If you are ordering a product from outside the UK the recipient of the product is responsible for all customs duties or tariffs incurred in the country to which the products are shipped. Furthermore your order may be subject to delay or be opened and searched by local customs authorities when entering the destination country. Please note we are unable to provide specific advice on customs duties or tariffs.

7. LIABILITY

7.1 Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, breach of contract or breach of statutory duty, nor will any of these terms restrict any of your statutory rights. For further information about your statutory rights, contact your local authority Trading Standards Department or Citizen's Advice Bureau.

7.2 In addition to paragraph 5.4, we will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment or road traffic problems.

7.3 The laws of the United Kingdom govern these terms and any dispute of any sort that may arise between you and YouPhorBee Naturals, may be dealt with in accordance to these laws. Regardless of any statute or law to the contrary, you must file any claim or action related to use of the Services or these Terms within one year after such claim or action is accrued. Otherwise, the claim or action will be waived.

7.4 The products and claims made about specific products on or through this site or information contained on any product label or packaging have not been evaluated by the NHS or the Food and Drug Administration and are not intended or approved to diagnose, treat, cure or prevent disease.  Nor is any information contained on or in any product label or packaging intended to provide or replace professional health care advice. The information provided on this site is for informational purposes only and is not intended as a substitute for advice or treatment from your doctor or other health care professional. You should not use the information on this site for diagnosis or treatment of any health problem.

9.1 All use and purchases made on this web site are governed by these Terms and Conditions at any time although the Terms and Conditions governing any given use or purchase will be those in effect at the date of your order or specific use. If you use or order goods after we have published any changes you will be bound by those changes. Accordingly, you should check prior to each order to ensure that you understand the precise terms and conditions applicable to your site visit or purchase. To assist you in determining whether the Terms and Conditions have changed since your most recent order, we will display the date and time when these Terms and Conditions were most recently updated.

9.2 We reserve the right, at our sole discretion, to modify or replace these Terms & Conditions at any time. Any changes will be published on the site as they occur and will apply with immediate effect. It is your responsibility to check periodically for any changes and your continued use of our services once a change has been implemented, means you accept any changes. 

10. RESELLING

10.1 The purchasing of YouPhorBee Naturals products should not be resold under any circumstances from this site.

11. CUSTOMER COMPLAINTS

11.2 We endeavour to respond to all customer complaints within five working days. On the rare occasion, we may get things wrong, so if we have made an unfortunate mistake and you have a complaint then please address it directly to YouPhorBee Naturals via email at info@youphorbeenaturals.co.uk.

11.2 If you are unhappy with the quality or condition of any products you have purchased from YouPhorbee Naturals, please address any complaints to YouPhorbee Naturals directly via phone or email (info@youphorbeenaturals.co.uk). An Order Confirmation and proof of delivery may be required and in order to issue any refunds where appropriate.

12. JURISDICTION

12.1 These terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms and Conditions, shall be governed by and construed in accordance with the law of England and Wales.
